David Becomes Goliath: Big Data, Biometrics, and the New Frontier of Plaintiffs' Litigation

The plaintiffs’ bar is undergoing a seismic transformation as firms like Morgan & Morgan leverage Big
Data and corporate-scale operations to reshape the litigation landscape. Once champions of the “little
guy,” these firms are now wielding vast resources, extensive data analytics, and complex
organizational structures to pursue high-value claims. This shift has thrown unexpected challenges
into large-loss cases, as red tape, poor communication, and inefficiencies often impede meaningful
negotiations and resolution.

This presentation will explore how the plaintiffs’ adoption of Big Data has affected defense strategies,
highlighting the emerging friction between corporate plaintiffs’ firms and defendants seeking swift,
cost-effective outcomes. Are we seeing a modern version of David becoming Goliath? More
importantly, how can defense counsel adapt to this new reality?
