We will offer a brief review of the background of UM/UIM coverage for Commercial Auto
programs in the fleet context, highlighting contract v. tort, significant state law variances
(statutes and judicial interpretations), and elections. We will then identify trouble spots like bad
elections, stacking, fee-shifting, employees v. independent contractors, and provide
examples/illustrations followed by a discussion of options for action when concerns are
identified.
