Transportation: Don't Forget UM/UIM! - Hazards And Pitfalls For Fleet Auto Liability Programs

We will offer a brief review of the background of UM/UIM coverage for Commercial Auto
programs in the fleet context, highlighting contract v. tort, significant state law variances
(statutes and judicial interpretations), and elections. We will then identify trouble spots like bad
elections, stacking, fee-shifting, employees v. independent contractors, and provide
examples/illustrations followed by a discussion of options for action when concerns are
identified.

Transportation: The 360° View - Managing Complex Investigations from 3 Perspectives - Plaintiff, Heavy Trucking, and Defendant

The session will discuss heavy trucking claims/litigation from the perspectives of three partieswith arguably different interests. The plaintiff wants a quick resolution but may not be preparedfor early prosecution. The heavy trucking client wants to focus on operations but needs to workwith counsel to preserve evidence and prepare fact witnesses. Defense counsel needs to move quickly and efficiently through the evidence and properly identify exposure. Plaintiff and Defendant both need to retain the most qualified liability and damages experts.
